1 USE OF THE VESSEL The charterer shall ensure that no pets or other animals are brought on board the Vessel without the consent in writing of the owner. The charterer shall ensure that the behavior of the charter party shall not cause a nuisance to any person or bring the Vessel into disrepute. The possession or use of any illegal drugs or any weapons (including particularly firearms) is strictly prohibited on board the Vessel and failure to comply shall be sufficient reason for the captain to terminate the Charter forthwith without refund or recourse against the owner. The charterer agrees to be responsible for and to replace or make good any loss or injury to the yacht, her equipment, linen, bedding, cutlery, crockery of furnishing, caused personally by himself or any of his party, but not if caused by negligence of the crew 2 CANCELLATION If the owner shall be given by the charterer notice of cancellation of this agreement on or at any time before commencement of the charter period, or if the charterer shall fail, after notice, to pay any amount payable under this agreement, the owner shall be entitled treat this agreement as having been repudiated by the charterer and to retain the full amounts of all payments made to the owner, before repudiation. If however, the owner is able to re-let the yacht to another charterer for all or part of the charter period, upon similar or discounted term then the owner, shall refund to the charterer such net balance as shall remain from the re-letting fee after deduction of all expenses and commissions incurred on the original charter and the re-letting. . 3 BOARDING, TIMING AND ITINERARY The charterer undertakes to respect sailing times and stops, as determined by the captain and the Itinerary of the boat. Must embark and disembark on time on the date, time and place set, any delays boarding must be arranged in advance and in any case the boat will not delay the start of more than 3 (three) hours of scheduled time. The itinerary can be subject of changes from the planned route due to the weather and sea conditions or by the motivated captain decision. 4 FAILURE TO DELIVER the boat is not available for boarding due to force majeure, the Owner shall make available to another vessel of the same class or higher(in terms of size and comforts). In the absence of such an opportunity , the charterer shall be entitled to a refund of cost of the cruise. If there was a cause of force majeure. Alternatively, if the parties mutually agree, the Charter Period shall be extended by a time equivalent to the delay. If during the vacation and for reasons not attributable to the charterer , the boat suffers a failure would affect the use of the owner will be required to pay to the Lessor the rate of the day of the lease 5 BREAKDOWN OR DISABLEMENT If after delivery the Vessel shall at any time be disabled by breakdown of machinery, grounding, collision or other cause so as to prevent reasonable use of the Vessel by the CHARTERER for a period between twelve (12) and twenty-four(24) consecutive hours the OWNER shall make a pro rata refund of the Charter Fee for the period of the disablement or, if mutually agreed, allow a pro rata extension of the Charter Period corresponding with the period of disablement. If the CHARTERER wishes to invoke this clause he shall give immediate notice in writing to the Captain. The CHARTERER shall remain liable for normal expenses during the period of disablement. 6 BAD WEATHER The owner assumes no responsibility for loss of time or l ' interruption of the charter for adverse weather conditions or provisions issued by the maritime authorities . In such circumstances, this Agreement will remain in full force 7 INSURANCE The owner shall insure the yacht with first class insurers against all customary risks for a yacht of her size and type, including, but not limited to, those risks, extended to provide permission to charter and to cover third party liability. The charterer shall carry independent insurance for personal effects whilst on board or ashore and for any medical or accident expenses incurred other than as covered under the yacht's insurance. Cancellation and curtailment insurance is not included in this agreement. 8 MISCELLANEOUS The owner shall not be responsible for any left or damage of the private things of the Lessor . It is strictly forbidden to smoke in the cabin, bathrooms and interior common areas.
